Description | John Robinson, parish of St Paule, Shadwell, Middlesex, mariner, claims that he was seised of a messuage, 40 acres of land etc in Witheronsay [Withernsea] in Holdernesse [Holderness] worth £10 per year, by copy of court roll He borrowed £70 from John Lindall, Hull, mariner, and surrendered the lands to the use of John Lindall by the custom of the manor, by way of a mortgage for £70 Claims that by a written agreement John Lindall would pay the yearly rent of £8 but never paid it and defrayed it towards payment of the £70 so should resurrender the land to John Robinson on payment of the remainder John Lindall claims that the £70 has not been paid according to the condition of the surrender so his estate has become absolute and he has paid a fine to the lord of the manor and a reversion fine The amounts paid are disputed John Lindall consented to an award but refused to seal it and refused to make any account John Robinson seeks a subpoena for John Lindall to appear in Chancery to answer to the premises Signed: Robert Foulkes 'William Carleton, gen Wilfr.
