TitleCopy petition to the Right Honourable the Lords Commissioners for the Custody of the Great Seal of England relating to land in Withernsea

DescriptionJohn Robinson, parish of St Paule, Shadwell, Middlesex, mariner, claims that he was seised of a messuage, 40 acres of land etc in Witheronsay [Withernsea] in Holdernesse [Holderness] worth £10 per year, by copy of court roll
He borrowed £70 from John Lindall, Hull, mariner, and surrendered the lands to the use of John Lindall by the custom of the manor, by way of a mortgage for £70
Claims that by a written agreement John Lindall would pay the yearly rent of £8 but never paid it and defrayed it towards payment of the £70 so should resurrender the land to John Robinson on payment of the remainder
John Lindall claims that the £70 has not been paid according to the condition of the surrender so his estate has become absolute and he has paid a fine to the lord of the manor and a reversion fine
The amounts paid are disputed
John Lindall consented to an award but refused to seal it and refused to make any account
John Robinson seeks a subpoena for John Lindall to appear in Chancery to answer to the premises
