DescriptionAward of Thomas Langley, gentleman, and Marmaduke Nelson, gentleman, to settle suits between Marmaduke Constable, Wassand, esquire, plaintiff, and George Pattinson, Hornsea, gentleman, Thomas Acklam, Hornsea, Herbert Cunningham, Hornsea, William Coniston junior, Hornsea, and William Arkesey, Hornsea, defendants (concerning trespasses in Hornsey [Hornsea] Marre, to which defendants have pleaded not guilty, or justified themselves as servants of Slingsby Bethell, London, esquire), and between Marmaduke Constable and others and Peter Acklam, Hornsey, gentleman, and others
Fishing and fowling of Hornsey Marr belongs solely to Marmaduke Constable, who shall also have 'the hills or batts within the bounds of the said Marr' (place called Kirkham excepted); place called Kirkham and dikes called Streame Dyke, Fosse Dyke, Lund Wyke Dyke and Coye Dyke to the verge of Hornsey Marr, and the Clow, are parcel of the manor of Hornsey, but Marmaduke Constable may set nets for fish in Land Wyke Dyke and Coye Dyke and in the mouth of Stream Dyke adjoining the Marr; Marmaduke Constable may take sods on the common ground on the north side of the Marr within ten yards of the Marr, and on the south side in a place called the Lund within four yards of the Marr; Marmaduke Constable to have right of way through the Lund, with a stalking horse or on foot, to shoot fowl in the Marr (closing gates after them); Marmaduke Carr may drive his sheep on to the common belonging to Hornsey, to wash them in the Marr; his tenants to have the same privilege, paying 2d for every score of sheep; the clow and fish-house erected on the soil of the manor of Hornsey Crosse, over Stream Dyke, not to be kept too long open or shut so as to drain or overflow lands of Marmaduke Constable in Wassand or the batts and hills where the fowl build and breed; Marmaduke Constable to cease all prosecutions, and parties to make general quitclaims of all suits and actions between them
